Guest Lecture on Media Trials- Hindrance to Natural Justice System

Amity Law School, Amity University Haryana organized a guest lecture “Media Trials- Hindrance to Natural Justice System” on 22nd March 2022. With an eminent industry expert Mr. R.H.A. Sikander, Advocate, Supreme Court of India.

Speaker began the Lecture by stating that the two principles of Natural Justice System Nemo Judex Causa Sua and Audi Altrem Partem can never be ignored. He then explained the meaning of the term ‘Trial by Media’ as a pre decided outcome of an ongoing case. He referred to the case of R.K. Anand v Registrar H.C. of Delhi where the three Judge Bench of the Hon’ble Supreme Court observed that the expression Media Trial means the intense impact of television and newspaper coverage on a person’s reputation by creating a widespread expression of guilt. “This is akin to mob lynching and the accused is not able to live their further lives without public scrutiny”, he said.

The Lecture imparted knowledge that the press does not simply publish information about cases and trials but subjects the entire hierarchy of the administration of justice (police, prosecutors, lawyers, judges, courts), as well as the judicial processes, to public scrutiny.
