Mr. Vikas Singh Senior Advocate, Supreme Court of India,Former Solicitor General of India and Former President, Supreme Court Bar Association delivered leacture on Judicial Independence vis a vis Judicial Activism / Overreach
Amity Law School, conducted a Webinar on Judicial Independence vis a vis Judicial Activism / Overreach. The Session was chaired by Mr. Vikas Singh, Senior Advocate, Supreme Court of India, Former Solicitor General of India and Former President, Supreme Court Bar Association. More than 300 students and faculties attended the webinar.
Mr. Vikas Singh explained the concept of Independence of Judiciary as assigned to it by the Constitution and how this is maintained by the Collegium System in selecting Judges for High Courts and the Supreme Court. He, however, pointed out that there is a need to have objectivity in the selection of Judges by laying down Guidelines for the said selection. This would bring objectivity in such selection and removal. allegations of nepotism. Mr Vikas Singh explained what is outreach and activism! He said that on numerous occasions when the Courts forget the distinction between their independent approach and outreach, there is a need to remind the Court about it and the Judges realize and retract. He said that he did it politely on numerous occasions and the Courts corrected themselves. He pointed out that PILs have brought in a lot of good to the Administration of Justice in our Country and suggested that PIL being Original Jurisdiction of the Court, there should be an Intra Court Appeal also available against the decision thereon.
The Address by Dr Vikas Singh was followed by a flurry of questions which were duly answered by him. This made the Webinar highly interesting and interactive.
