Amity Law School, AUH conducted a Webinar on "Future of Litigation in India and e-Courts", The idea behind this Webinar was to enlighten the participants and provide them with deep insight of Future of Litigation in our Country and scope of e-Courts after this current Pandemic situation. The Panelist for said Webinar was Hon’ble Mr. Justice Swatanter Kumar, Former Judge Supreme Court of India and Former Chairperson, National Green Tribunal. The Event received fabulous response from all around the globe and was attended by 464 participants, including many foreign attendees.
In his address, the Honoured Guest explained the traditional modus operandi of our legal system. He said that in this difficult time created by the Pandemic, a lot of hue and cry is being created regarding the functioning of Courts post this situation. Heopined that India is the largest democracy in the world and we have a system for Administration of Justice, which had been established in our country more than 100 years ago and it is not so easy to take a complete shift therefrom. He said that considering the vastness of our Country, the hierarchy of Courts, the procedures to be adopted for Trials and non-availability of proper Internet Infrastructure, we can not put the entire Judicial System to operate through e-Mode. Yes, there will be changes for which the younger generation of Advocates should keep them abreast with. Lordship’sAddress was followed by Question-AnswerSession and doubts raised by the participants were clarified by the Lordship. Some important questions which he answered are as follows:
- Cyber Crimes are increasing day by day, but we don’t have stringent laws to tackle these in our Country. How do we tackle this exponential growth of Cyber Crimes?
- What will be the future of ‘Lok Adalats’ and other Alternate Dispute Resolution systems?
- Do you believe that introduction of e-Courts in India will be a game-changer in addressing the problem of delay in the Justice delivery system? Will there be more of e-Filings and E-Courts?
4. Will the Country have only e-Courts as our justice dispensation legal system?
5. There are a staggering number of FIRs being filed by Police against violations of Lockdown Guidelines. Will these be legal as there is a requirement foe an Informant to file an FIR?
6. With the constant advancement of Technology and crimes relating thereto, will there be a need to have a separate Technology Court?
7. What advise will Lordship give to the future Advocates to prepare themselves for this e-spurt?
The objectives of the event were to demonstrate the various modes of operation to be followed after this global Pandemic for better implementation of Justice. It Highlighted the basics attributes essential in order to establish e-Courts in our Country and explained various safeguards to be followed in the administration of Justice by making optimum utilization of technology and Enlighten the participants regarding complex issues involved in Lok Adalats, Alternative Dispute Resolution mechanism, and Cyber Crimes, etc.
