Indian Evidence Act needs restructuring to match the advancement of Medical Jurisprudence asserted Hon’ble Dr. M. Veerappa Moily, Minister of Law & Justice, Govt. of India

Hon’ble Dr. M. Veerappa Moily, Minister of Law & Justice, Govt. of India inaugurated the 10th Indo-Pacific Congress on Legal Medicine & Forensic Science INPALMS 2010 at Amity University.

Addressing the august gathering he said, “to resolve conflict at the time of turbulence, I came out with the slogan expulsion, inclusion and excellence which is the real mantra for the future success of the country. We need to nurture our nation by nurturing the judicial system with the current developments in the field of science and technology. Search for truth is a reality which gives us mobility and helps us to achieve great heights. I strongly believe that India will have the world class infrastructure in the coming twenty five years. We can build ourselves and our nation on firm ethical foundations. To take this recourse to action law, medicine and science are to be interlinked. Law and legal science cannot lag behind. We need to match with the developments in the respective fields. The applicability of every branche of medical field has to be explored and law is to be connected to it and studied. As law is usually comprehensive and physicians have limited knowledge of law, therefore there should be a link for smooth functioning of things in both profession law and medicine. Forensic Medicine can also be used as physical evidence for various judicial cases.

Dr. Veerappa Moily asserted that future aspects of jurisprudence are Forensic Science. It is dynamic science. The Minister said that Indian Evidence Act is not very responsive to the Medical Sciences therefore there is a need to restructure the IEA to match the advancement of Medical Jurisprudence.

Dr. Ashok K. Chauhan, Founder President, Amity Group, Patron-in-Chief of INPALMS-2010 also graced the occasion with his presence and announced 10 P HD in the area of Forensic Science in the University.

Over 110 experts of Forensic Science dwelled over issues on Forensic Science & Crime Scene Investigation during the congress. Dr. Roger Byard, Chairperson, Pathology, University of Adeliede, Australia gave a presentation on “Forensic Medicine”, Dr. Philip Beh, Institute of Pathology, Hongkong University presented the topic “Problem Based Learning”, Dr. Ali Chadly, Prof. and Head of the Department of Forensic Medicine, Tunisia on the topic Forensic Anthropology, Mr. Henry Lee, Prof. and Director, University of New Heaven, USA gave his presentation on the topic “Crimes Scene Investigation”, Special session on Ethics in relation to Health Sciences by Dr.M. Haq, WHO, New Delhi, Dr. T.D. Dogra, Prof & Head , Dept. of Forensic Medicine & Toxicology, AIIMS, Teaching of Ethics in South East Asian Regional Countries by Dr. Weerasundra B.J, South-East Asian Association for Health Ethics, Sri Lanka, Medical, Legal and Ethical Issues in a Case of Body Packer who under went Laparotomy by Rajapaksha W.R.A.S, Gunathilaka G.K.K, Sri Lanka, Patients Rights in the Health System of Azerbaijan by Mustafayeva A.I., Mammadov V.Q., Institute on Human Rights, National Academy of Sciences of Azerbaijan, Baku

Dr. Roger Byard, Chairperson, Pathology, University of Adeliede, Australia while giving his presentation on “Forensic Medicine” said that forensic investigation of sudden death of infants and young children and stressed on the concerns regarding unexpected deaths of the young children. The pathologist plays a significant role in the police investigation of the crime cases. It helps in negative as well as positive findings of the cases and also helps to access the case in photographs.

Dr. Philip Beh, Institute of Pathology, Hongkong University presented the topic “Problem Based Learning.” He asserted that there are limitations on the traditional mode of teaching. According to Dr. Philip information expression means learning has to be focused and should have relevance for medical needs. Lack of information has become a problem amongst the students. He emphasized that healthy personal and professional relationship of the tutors or facilitators with the students are essential to make the learning environment friendly. Problem Based Learning emphasizes on teachers to assist students in active learning, students are given opportunity to talk on the stipulated subjects and the teachers listen to them, the starting point of learning is through a real clinical problem, free time is allotted for self learning, students are encouraged to think critically and the teachers know personally what the students have to learn and what they have learnt.

Dr. Ali Chadly, Prof. and Head of the Department of Forensic Medicine, Tunisia made a demonstrative presentation on Forensic Anthropology with the help of bone models. Male and female bone structures are analyzed indeptly from forensic and crime investigative angle.

Mr. Henry Lee, Prof. and Director, University of New Heaven, USA made his presentation on the topic “Crimes Scene Investigation” and gave a detailed analysis on the photographs taken of the crime spots. Crime Scene Investigations procedures were shown in a distinctive and elaborate manner. He showed the audience how to find out clues from the crime spot and gave logical reasoning as a crime investigator and also as forensic scientist.
