Justice Arijit Pasayat, Former Judge Supreme Court of India delivers lecture on "Judicial Independence in India" at Amity Law School Centre - II

Justice Arijit Pasayat, Former Judge Supreme Court of India delivered lecture on "Judicial Independence in India" at Amity Law School Centre - II on October 29, 2013. Prof. Mamta Srivastava, Addl. Director, ALS Centre II welcomed Justice Pasayat.

In his lecture, the former judge of the Supreme Court of India talked on the subject of Judicial Independence in India. He referred to the words of the framers of the constitution and other scholars. He said that a country is known by the kind of the judiciary it has. However, he expressed his concern that if the judiciary is made to do everything, it would be an antithesis to the concept of democracy. He also highlighted the issue of 60 lakh pending cases in High Courts and approximately 50 thousand cases in the Supreme Court. Referring to this issue, he said that apart from increasing the number of judges in the judiciary, the independence of the judiciary is a prerequisite for smooth functioning of democracy. He also supported independence of individual judges for the independences of the judiciary. Only an independent judiciary, according to him, can act as a watchdog and supervise the doctrine of separation of powers. Lastly, he raised a question on the efficacy of governance. He said that the people of the country have reposed utmost faith in the judiciary, which signals the failure of the other organs of our democracy.

At the end of the lecture, the students asked questions related to reservation in the public sector and post-retirement jobs for judges.

Prof. Mamta Srivastava, Addl. Director, Amity Law School Centre -2 felicitated the distinguished guests by presenting a shawl, sapling and memento to Justice Pasayat
