Bhosale- Judge, High Court of Karnataka.

Hon’ble Dr. Manmohan Singh- Prime Minister of India inaugurated the Golden Jubilee Celebrations of BCI along with Dr. Ashwani Kumar- Hon’ble Minister of Law and Justice, Hon’ble Mr. Justice Altamas Kabir- Chief Justice of India.

The inauguration was followed by Seminars on various topics wherein Hon’ble Union Ministers, Hon’ble Judges of Supreme Courts and High Courts, eminent Sr. Advocates and Jurists, foreign dignitaries and noted academicians shared their views.

During a session on “Judicial Delays and Access to Justice”, Mr. Arun Mohan- Sr. Advocate, Delhi High Court opined that as India grows as a nation, the demand for justice also grows. The key to poverty removal and economic development of the country is “Rule of law and access to justice by one and all”. He remarked that it is the duty of lawyers to work out methods and ways to ensure “low cost and timely justice” to the masses. If all the lawyers spare 2% of their intellectual resources and time in this area, then a low cost and speedy justice mechanism will evolve for real economic development.

Delivering the key note address, Mr. Arun Jaitley- Sr. Advocate and Leader of Opposition, Rajya Sabha, Parliament of India suggested that courts should be accessed as last resort for settling the disputes. Mediation should be preferred to save people from harassment and getting the grievances addressed on time. He called upon the government to increase the investment in the judicial system. The speaker revealed that the number of cases which are filed and which are disposed every year is not same which points out the dearth of disposers, calling for training of specialized manpower in this area. Number of Courts should be increased and the cost involved in setting up a Court is not exorbitant in a country like India. The strength of judges should be increased at least 10% every alternate year to ensure the pendency of cases is reduced.

Prof. (Dr.) Ranbir Singh- Vice Chancellor, National Law University, sharing his views during the session, stressed that access to justice is a big issue and a major cause of concern in India especially where 920 million people live on Rs. 20 per day. Poor people living on pavements, footpaths and roads are the ones who are denied justice. Prof. Singh stated that the rule of law is not the rule of justice and if justice is not there then there cannot be any Law. Doling out few suggestions, Prof. Singh stressed that let Courts of Law become the Courts of Justice so that common man is not scared to enter the Court of Law. More Lok Adalats and Mobile Courts should be held to dispose off the pending cases in a speedy manner.
