UGC Recognition

  1. Knowingly, there has been a lot of confusion in the minds of the public regarding recognition of Universities by UGC. To rectify this misconception, Amity University Uttar Pradesh (AUUP) had filed a Writ Petition against UGC in the Delhi High Court.

  2. The Hon’ble High Court (both the single Bench as well as the Double Bench) has held in its Judgement that :

    “There is no provision in the UGC Act or in the Regulations that has been referred to which requires the prior recognition/approval of UGC before a University is regarded as one falling under Section 2 f of the UGC Act. The only requirement is that the University must have been incorporated and established by virtue of a Central Act, a Provincial Act or a State Act. This contention is clearly satisfying in the case of the Respondent [Amity] University by virtue of the enactment of the Amity University Uttar Pradesh Act 2005…”

    UGC themselves have also, in a sworn affidavit, stated that Amity University is a University established as per Section 2 f of UGC Act and is competent to award valid degrees under Section 22 of UGC Act. The Hon’ble High Court has recorded this submission of UGC in their Order. The copy of this Order, including the relevant portion of the affidavit of UGC, as recorded by the Hon’ble High Court is placed alongwith.

  3. UGC used to maintain a list of Universities, which was also causing confusion as some Universities were not included in the list. As the list was non-statuatory (illegal), UGC scrapped the list and informed this to the Hon’ble High Court. As the Hon’ble High Court had already directed UGC to include the name of Amity University in their list of Universities, if ever UGC brings out the list again, they will have to include the name of Amity University in the list.

  4. Through the various Judgments and Orders, the Hon’ble High Court has clarified all the doubts and confirmed that Amity University is a University established as per UGC Act and competent to award degrees valid under law (UGC Act). In the month of November all the leading Newspapers of the Country have covered the above position as ascertained and directed by the Hon’ble High Court in favour of Amity University and against UGC
